1. Overview & General Policy

At nithishreddy.in, we are committed to providing exceptional Digital Marketing, SEO, and Web Development services. We strive to work efficiently and professionally to meet the goals outlined in our project proposals. However, it is important to establish a clear understanding of the financial and operational agreements that govern our services to ensure a transparent and trusted business relationship.

1.1 Nature of Services

Unlike companies that sell physical products (which can be returned or exchanged), nithishreddy.in provides non-tangible, irrevocable digital services. We sell our time, intellectual property, and professional expertise.

Once a service has been performed, code has been written, or a strategy has been executed, it cannot be “returned.”

Therefore, we generally do not issue refunds for any services that have already been performed or for work that has been completed and delivered to the client.

1.2 Commitment to Satisfaction

While our policy is strict regarding completed work to protect our livelihood as freelancers, we are dedicated to client satisfaction. We encourage clients to contact us immediately if they are dissatisfied with the service received so that we may attempt to resolve the issue through revisions or support, strictly within the scope of the agreed-upon project.

2. Project Cancellation by the Client

We understand that business priorities can change. If you (the Client) wish to cancel a project or service agreement, you must submit a written cancellation request via email to contact@nithishreddy.in. The following refund terms apply based on the stage of the project at the time of cancellation:

 

2.1 Cancellation Prior to Project Initiation

If a cancellation request is received before any work has commenced (including research, strategy planning, or design drafts) and within 48 hours of the initial payment:

We will issue a full refund of the amount paid, minus a 10% administrative processing fee. This fee covers the costs associated with invoicing, payment gateway charges, and client onboarding.

2.2 Cancellation During Active Project Execution

Once the project has officially commenced (i.e., we have started research, design, coding, or campaign setup), the initial deposit or advance payment is non-refundable.

Rationale:

The deposit serves to reserve our time, resources, and schedule for your specific project, preventing us from accepting other potential work.

Pro-Rata Payment:

If the work completed up to the point of cancellation exceeds the value of the initial deposit, the Client is liable to pay for all work completed at our standard hourly rate or based on the percentage of project milestones achieved.

2.3 Notice Period for Ongoing Services

For recurring services such as Monthly SEO Retainers or Social Media Management:

  • Clients must provide a 30-day written notice for cancellation.
  • If a cancellation is made in the middle of a billing cycle, the client will be billed for the remainder of that month. No partial month refunds will be issued.

3. Cancellation by the Service Provider

3.1 Grounds for Termination

We may cancel a project if the Client:

  • Breach of Agreement: Fails to provide necessary assets, content, or feedback required to complete the project within a reasonable timeframe (causing significant project delays).
  • Scope Creep: Consistently demands tasks or features that are outside the agreed-upon Scope of Work without agreeing to a revised budget.
  • Unprofessional Conduct: Engages in abusive, threatening, or unreasonable behavior towards our team.
  • Non-Payment: Fails to adhere to the agreed-upon payment schedule.

3.2 Financial Settlement upon Termination

In the unlikely event that nithishreddy.in initiates the cancellation of a project:

  • For Cause (e.g., Non-Payment/Abuse): We retain the right to keep the deposit and bill for all billable hours worked up to the date of termination.
  • For Convenience (e.g., We cannot complete the project due to unforeseen circumstances): We will provide a pro-rata refund. This means we will calculate the value of the work already completed and delivered. Any amount paid by the Client in excess of this value will be refunded within 14 business days.

Note: Example: If you paid ₹20,000 for a project and we cancel after completing 50% of the work, we will refund ₹10,000.

4. Refund Eligibility (Service-Specific Protocols)

Due to the distinct nature of the various digital services provided by nithishreddy.in, specific refund stipulations apply to each category of service.

4.1 Web Design & Development

Web development projects involve significant coding, configuration, and design hours. Therefore, the following milestones determine refund eligibility:

  • Design Phase: If the Client cancels after the initial mock-ups/wireframes have been created but before approval, a partial refund may be issued (minus hours worked).
  • Development Phase: Once the design has been approved by the Client and coding/development has commenced, no refunds will be issued.
  • Post-Deployment: Once the website files have been migrated to the Client’s server, or the website has been launched live to the public, the project is considered complete and is strictly non-refundable.

4.2 Search Engine Optimization (SEO) & Marketing

  • Important Disclaimer regarding Performance: SEO is a long-term strategy influenced by third-party search engines (e.g., Google, Bing) whose algorithms change frequently and without notice.
  • No Performance Guarantees: While we employ ethical, white-hat industry-standard practices, nithishreddy.in does not and cannot guarantee specific search engine rankings, traffic numbers, or sales conversions.
  • Non-Refundable Policy: Payment for SEO services is for the time, work, and expertise applied to the campaign (e.g., keyword research, content optimization, link building), not for a specific outcome. Therefore, no refunds will be issued based on rankings or performance metrics.

4.3 Monthly Retainers & Maintenance

For ongoing services (e.g., Website Maintenance, Social Media Management, SEO Retainers):

  • Cancellation Notice: A mandatory 30-day written notice is required to cancel any recurring service.
  • Current Month Billing: If a cancellation notice is received during an active billing cycle, the Client is responsible for the full payment of that current month. We do not offer pro-rated refunds for partial months of service.

5. Non-Refundable Cost Components

In the execution of Digital Marketing and Web Development projects, nithishreddy.in often purchases products or services from third-party vendors on behalf of the Client. These “pass-through” expenses are strictly non-refundable under any circumstance, as these funds are paid directly to external providers and are not held by us.

5.1 Third-Party Assets & Licenses

The following items are non-refundable once purchased:

  • Domain Names & Web Hosting: Payments made for domain registration or hosting server setup are paid to registrars and hosting companies. These providers do not offer refunds once a domain is registered or a server is provisioned.
  • Premium Themes & Plugins: Costs associated with purchasing third-party software licenses (e.g., WordPress Themes, Elementor Pro, Premium SEO Tools) are non-refundable once the license key has been activated or the file downloaded.

5.2 Advertising Budgets (Paid Media)

For Pay-Per-Click (PPC) campaigns (e.g., Google Ads, Meta Ads):

  • Media Spend: The budget paid directly to advertising platforms (Google, Facebook, LinkedIn) for ad placement is non-refundable. We cannot recover funds once they have been spent on ad impressions or clicks.
  • Management Fees: While our management fee is subject to the cancellation terms in Section 2, the actual ad spend is entirely under the control of the respective ad platform’s billing policies.

6. Project Abandonment & Dormancy Policy

To maintain an efficient workflow and ensure fair scheduling for all clients, nithishreddy.in enforces a strict Project Abandonment Policy.

6.1 Definition of Abandonment

A project is considered “Abandoned” if the Client fails to provide necessary information, content, feedback, or approval for a period of 30 consecutive days.

This includes failure to respond to email communications, failure to attend scheduled meetings, or failure to deliver required assets (such as images, text, or credentials) preventing the project from progressing.

6.2 Effect of Abandonment

If a project remains in a state of abandonment for 30 days:

  • The project will be automatically marked as “Cancelled by Client.”
  • All work will be suspended, and the project will be removed from our active production schedule.
  • Financial Forfeiture: Any deposits, advances, or progress payments made up to that point are strictly non-refundable. These funds serve as compensation for the time reserved and the opportunity cost of turning down other business.

6.3 Project Reactivation

If a Client wishes to resume an Abandoned project after the 30-day period:

  • Reactivation is subject to our current availability and schedule.
  • A Reactivation Fee (typically 15-20% of the total project value) may be applied to cover administrative costs and re-onboarding.
  • If our service rates have increased during the dormancy period, the project will be re-quoted at the new current rates.

7. Cancellation & Refund Request Procedures

To ensure clarity and prompt processing, all requests for cancellation or refunds must adhere to the following formal procedure.

7.1 Formal Submission Channel

We do not accept cancellation requests via social media (WhatsApp, LinkedIn, Instagram) or telephone. All requests must be submitted in writing via email to our official billing department:

7.2 Required Documentation

Your email must include:

  • Project Identification: The specific invoice number or service agreement date.
  • Reason for Cancellation: A clear explanation of why you are requesting the cancellation.
  • Bank Details: (If applicable) Preferred bank account details for the refund transfer, should the request be approved.

7.3 Review & Processing Timeline

  • Review Period: Upon receipt, we will review your request against our Service Agreement and work logs within 5-7 business days. We will notify you of the approval or rejection of your refund request via email.
  • Refund Execution: If a refund is approved, it will be processed within 7-14 business days from the date of approval.
  • Banking Delays: Please note that once we initiate the transfer, the time taken for the credit to reflect in your account depends on your bank’s processing times and is outside our control.
